Collaborative Accommodation: New Regulations for Tourist Accommodation Establishments Come Into Force

As of May 1, 2020, the new Tourist Accommodation Establishment Regulations will come into force. This regulation, which was requested by our members, will allow for a better supervision of so-called collaborative accommodation, notably because
The draft regulation proposes to remove the notion of renting on a regular basis. It specifies that from the first night, the operator of a “principal residence” establishment must first comply with the Regulation. It also clarifies the concept of principal residence.
Guests of principal residences will be required to obtain a simplified registration number, but will not be required to be classified by the Corporation de l’industrie touristique du Québec (CITQ).
Guests of secondary residences and timeshares will be required to obtain an attestation of classification from the CITQ with their registration number.
The registration number will have to be displayed in all advertising, contracts and Internet sites related to the operation of the residence, which will allow for more effective control.
To obtain a registration number, a tenant who wishes to operate his dwelling must provide the landlord’s authorization to do so. For his part, an owner whose principal residence is located in a building held in divided co-ownership ”i.e. a condo” will have to submit the authorization of the syndicate of co-owners.
We fully understand the situation in which you are currently evolving. However, we would like to remind you that this regulation requires you to put your attestation number on each of your digital media. This establishment number consists of 6 numbers and is indicated on the confirmation letter of your classification attestation.
We invite you to carefully read the attached communiqué from the Ministry of Tourism (HERE), to obtain all the information.
Here is a paragraph of the release that is particularly important to you, the accommodation owners:
Revenu Québec inspectors continue to ensure compliance with the Act and Regulation respecting tourist accommodation establishments. In the current context, particular attention will be paid to the display of the attestation number on digital media. Promotional tools already printed will be available, but the establishment number will have to be integrated into those that will be printed as of today.
As for your printed materials, you can sell them. When your promotional tools are reissued, they will have to include your attestation number. If you have any questions, or need additional information, please do not hesitate to contact us.
